Terms of Service

1. About These Terms

These Terms of Service govern your use of the apexgp.co.nz website and your participation in activities, sessions, events and memberships provided by APEX GP Academy (“APEX GP”, “we”, “us”, “our”). By using our website, making a booking or taking part in any activity, you agree to these Terms. If you are booking on behalf of a child, you accept these Terms on their behalf as their parent or legal guardian.

These Terms operate together with our Return and Refund Policy and Privacy Policy. Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

2. Bookings and Payment

•     A booking is confirmed once payment has been received and you receive confirmation from us.

•     Prices are listed in New Zealand dollars and include GST where applicable.

•     We may update pricing and session availability from time to time. Changes do not affect bookings already confirmed.

•     Cancellations, reschedules and refunds are handled under our Return and Refund Policy.

3. Eligibility, Age and Supervision

•     Our academy is designed for riders aged 3 to 16. Some sessions have specific age, height or experience requirements, which will be stated at booking.

•     Participants under 18 must have a booking made and consented to by a parent or legal guardian.

•     A parent or guardian must remain contactable, and where required present, for the duration of a minor’s session.

•     We may decline participation, without refund, where a participant does not meet stated eligibility, safety or age requirements that were communicated before purchase.

4. Safety, Conduct and Assumption of Risk

Motorsport activity carries inherent risks, even in a structured and supervised environment. By participating, you acknowledge and accept these risks on your own behalf and, where applicable, on behalf of your child.

•     All participants must follow instructions from APEX GP staff, wear required protective equipment, and comply with our safety guidelines at all times.

•     You must disclose any medical condition or injury that may affect safe participation before a session.

•     We may require a signed waiver or acknowledgement of risk before participation. Refusal to complete a required waiver may prevent participation, without refund.

•     We may suspend or remove any participant behaving unsafely, disruptively or contrary to staff instructions, without refund.

5. Equipment and Property

•     Equipment provided by APEX GP remains our property and must be used only as instructed.

•     You are responsible for any loss or damage to our equipment caused by misuse, negligence or failure to follow instructions.

•     We are not responsible for personal belongings brought to our premises or events.

6. Media and Content

We may photograph or film sessions and events for promotional and educational content across platforms including Instagram, YouTube, Facebook and 小红书. If you or your child do not wish to appear in this content, please tell us in writing before a session and we will make reasonable efforts to accommodate this. Where you submit content or tag us, you grant us permission to reshare it with credit.

7. Website Use and Intellectual Property

•     The APEX GP name, logo, graphics and content on apexgp.co.nz are our property or used under licence, and may not be copied or used without permission.

•     You agree not to misuse the website, attempt to disrupt it, or use it for any unlawful purpose.

8. Liability

To the extent permitted by law, and subject to the Consumer Guarantees Act 1993, APEX GP is not liable for indirect, incidental or consequential loss arising from your use of our website, activities or services. Where we are found liable, our total liability is limited to the amount you paid for the relevant booking or service. Nothing in these Terms excludes liability that cannot lawfully be excluded, including for personal injury caused by our negligence to the extent the law does not permit exclusion.

9. Changes to These Terms

We may update these Terms from time to time. The current version will always be available on apexgp.co.nz, and the “Last updated” date will reflect the latest revision. Continued use of our website or services after changes take effect constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of New Zealand, and any disputes are subject to the jurisdiction of the New Zealand courts.
